Introduction

The following terms and conditions (the “Agreement”) govern the consulting Power Hour (the “Service”) provided by Meg O’Gara | Megnificent Digital Agenct Ltd. T/A Megnificent Creative (“Consultant,” “we,” “us,” or “our”) to you (“Client” or “you”). By participating in the Power Hour, you agree to be bound by these terms and conditions.

Scope of Service

The Service offered by the Consultant is a one-hour consulting session, during which specific topics or challenges related to Business & Branding will be addressed. The Consultant will provide professional advice, guidance, and expertise to the best of their abilities based on the information provided by the Client.

Fees and Payment

The Client agrees to pay the applicable fee for the Power Hour service as agreed upon in advance. Payment must be made before the scheduled Power Hour session begins. Accepted payment methods and invoicing details will be provided by the Consultant.

Scheduling and Rescheduling

The Client and Consultant will mutually agree upon a suitable date and time for the Power Hour session. If the Client needs to reschedule the session, they must provide at least a notice period of 24 hours prior to the scheduled time. Failure to do so may result in the forfeiture of the session, and no refund will be provided.

Cancellation and Refunds

In the event that the Consultant is unable to fulfill the scheduled Power Hour session due to unforeseen circumstances, the Client will be entitled to a full refund or may reschedule the session at a mutually agreed time.

Confidentiality

Both parties agree to maintain strict confidentiality regarding any information shared during the Power Hour session. The Consultant will not disclose any proprietary, sensitive, or confidential information obtained from the Client without prior written consent, except as required by law.

Recordings and Presentations

The Client is permitted to record the consulting Power Hour session for their personal use and reference. However, the Consultant will not record the session. The Client agrees to use any recordings responsibly and solely for their internal purposes, ensuring confidentiality and secure storage. No sharing, distribution, or publication of the recording in any public domain or with third parties is allowed without the prior written consent of the Consultant. Any presentation materials provided during the Power Hour session are for the exclusive use of the Client and may not be reproduced, shared, or distributed without the Consultant’s prior written consent. All intellectual property rights related to the Power Hour session remain the property of the Consultant. The Client grants permission to the Consultant to use provided testimonials or feedback for marketing and promotional purposes, with respect for the Client’s privacy and anonymity if requested.

Limitation of Liability

The Consultant will make every effort to provide accurate and valuable advice during the Power Hour session. However, the Consultant shall not be liable for any direct, indirect, incidental, or consequential damages or losses resulting from the Client’s use of the information provided during the session.

Intellectual Property

All materials and content provided by the Consultant during the Power Hour session remain the intellectual property of the Consultant. The Client agrees not to reproduce, distribute, or share any materials without the prior written consent of the Consultant.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Ireland, and any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Ireland.

Amendments

The Consultant reserves the right to modify or update these terms and conditions at any time. Any changes will be communicated to the Client in writing or through the Consultant’s website.

By completing onboarding and attending the Power Hour session, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Agreement.
